Terms of Service

1. Acceptance of Terms

These Terms of Service govern your use of the website at curvaero.com and of the CurvAero applications and API (together, the "Service") provided by CurvAero, Inc. ("CurvAero"). By using the Service, or by registering an organization account, you agree to these Terms on your own behalf and, where applicable, on behalf of the organization you register. If you do not agree, do not use the Service.

2. Description of Service

The Service comprises the Analysis Platform (FAA Part 77 obstruction evaluation, RF line-of-sight analysis, FAA filing intelligence and site qualification); Drone Operations (flight planning, fleet management, geofences and airspace awareness); Data Distribution (aeronautical and airport datasets, map tiles and a REST API); and Enterprise arrangements such as white-label deployments and custom integrations. The features available to you depend on your plan.

3. Accounts

Organizations register an account and invite their users. You are responsible for the accuracy of the details you register, for keeping your credentials confidential, for the API keys you generate, and for all activity under your organization’s account. Tell us at support@curvaero.com immediately if you believe an account or API key has been compromised.

4. Plans, Usage Limits and Invoicing

Plans
The Service is offered on Trial, Basic, Pro, Pro Plus and Enterprise plans. Each plan includes a set of features and monthly usage limits, such as the number of Part 77 screenings. Usage is metered and counted against those limits; add-ons and per-screening overage are available on some plans.
Trial
A newly registered organization starts on the Trial plan, which is free and limited. A subscription cannot return to Trial once it has moved to a paid plan.
Invoicing
Paid plans are invoiced; they are not charged to a payment card. A subscription runs on a monthly or annual billing cycle. For each billing period CurvAero issues an invoice in US dollars listing the plan fee, active add-ons, any usage overage and any adjustments, with a due date. Payment is made by the method agreed with CurvAero and is recorded against the invoice by CurvAero. CurvAero does not collect or store payment card details.
Plan changes
A plan or billing-cycle change takes effect immediately: a new billing period starts on the day of the change and is invoiced from then. Fees for the remainder of the previous period are not prorated automatically; where an adjustment is warranted, CurvAero adds it to the next invoice. Enterprise and other non-public plans are assigned by agreement, not self-service.
Cancellation
You may cancel at any time. Cancellation takes effect at the end of the current billing period; the plan remains usable until then and can be reactivated before the period ends.
Late payment
If an invoice is not paid by its due date, CurvAero may, after notice, suspend access to paid features until it is settled.

5. Acceptable Use

You must not use the Service to break the law, to probe, overload or disrupt it, to resell access without an agreement with CurvAero, or to circumvent plan limits, rate limits or API keys. API access is rate-limited; requests beyond the limit are refused with an HTTP 429 response.

6. Data Accuracy Disclaimer

While CurvAero strives to provide accurate and up-to-date aviation data, our analyses are for informational purposes. Users are responsible for verifying results with authoritative sources (FAA, ICAO) before making regulatory filings or operational decisions.

The datasets are derived from public sources published by the FAA and other agencies and may lag those sources. The Service is not a substitute for official FAA determinations, NOTAMs or air traffic control.

7. Intellectual Property

The Service, its software and its compiled datasets belong to CurvAero or its licensors. Subject to these Terms and your plan, you may use the data and outputs you obtain through the Service for your organization’s own purposes. Public-domain source records remain in the public domain, and open-data sources keep their own licences; OpenStreetMap data, for example, is available under the Open Database License.

8. Limitation of Liability

CurvAero shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to decisions made based on analyses provided by the platform.

9. Termination

You may close your organization’s account at any time by contacting us. CurvAero may suspend or terminate access for a breach of these Terms. The sections on data accuracy, intellectual property and limitation of liability survive termination.

10. Changes to These Terms

We may update these Terms; the date at the top shows the current version. Material changes will be announced to account holders before they take effect. Continued use of the Service after a change means you accept it.
